Delinquent New Jersey Debtors

Not all cases need to be resolved in Court. We attempt to work with homeowners who want to pay their maintenance fees. Sometime lawsuits are necessary, however, and we are prepared to process and file them swiftly, and to pursue post-litigation remedies. Sometimes the only plausible remedy is foreclosure. In such cases, we assist by filing a lien, initiating a foreclosure Complaint, and attending the sheriff’s sale.

Liens by community associations are unique, in that they are only prioritized to a certain extent.  Thus, community associations have to be prepared to balance the association’s right to enforce a lien, against the rights of mortgagees. The foreclosure of a community association lien does not extinguish the rights of certain other lienholders, such as purchase money mortgages or the  rights of taxing authorities. You will need an attorney who can navigate potential roadblocks posed by other creditors.
