Amended Multiple Dwelling Reporting Rule (MDRR)

On April 7, 2025, the Division on Civil Rights (DCR) amended the Multiple Dwelling Reporting Rule (MDRR); this is what you need to know.

What is the MDRR?

The Multiple Dwelling Reporting Rule is a set of regulations enforced by the Division of Civil Rights (DCR), which require the owners of 25 or more dwelling units to provide demographic information on applicants and occupants and file them in an annual report with the DCR.

What has changed?

First, the amendment has expanded the definition of “multiple dwelling” which includes 25 or more total dwelling units such as apartments, condominiums, duplexes, townhomes, single family homes. These “dwelling units” include units in a single location or complex and now includes owners with 25 or more dwelling units across multiple locations in the State of New Jersey under one management or one owner.  

Second, the amendment makes it a requirement for owners to provide the DCR’s Tenant/Application Inquiry Form to their applicants and tenants/leaseholders. The form must be the updated MDRR Tenant/Applicant Inquiry form. Keep in mind, although the owner must provide the inquiry form, tenants/leaseholders and applicants are not required to complete or return the form. If the form is not returned or the applicant does not supply the information, owners are required to make a designation to the best of their knowledge pursuant to the Multiple Dwelling Report Worksheet’s instructions that can be found on the MDRR website.

Third, the amendment expanded reporting to include all known occupants. Prior to January 1, 2026, the reporting requirement was for tenants/leaseholders and applicants. The reporting requirement beginning January 1, 2026 is now extended to include “occupants”.

Fourth, the amendments have added demographic information. The new MDRR form asks tenants/leaseholders to voluntarily supply their gender, familial status, and receipt of rental assistance which are in addition to the previously garnered racial and ethnic demographic information.

Lastly, the amendments have added enhanced penalties for late filing. Owners who fail to file the MDRR report in a timely manner will be found in violation of the rules and will be subject to the following penalties:

More than 15 days, less than 30 days late = $500

More than 30 days, less than 60 days late = $1,000

More than 60 days, less than 90 days late = $1,500

More than 90 days = $2,500

It is important to note that even though an Owner may pay the fine, they still need to file the report.

When do these amendments take effect?

The new amendments apply to the data collected after January 1, 2026 which will be reported on in January 2027 and later. The reporting deadline continues to be January 30. Therefore, beginning on January 1, 2026 owners under the MDRR must provide applicants and tenants/leaseholders the new updated Inquiry form for reporting due no later than January 30, 2027. Owners should continue to use the pre-amendment MDRR tenant/applicant inquiry form and report worksheet for January 1 through December 31, 2025 data and reporting.
