Community Association Law
Community Association Law is a primary practice area of Griffin Alexander, P.C. This is because more and more communities are maintained by nonprofit community associations, administered by volunteer Boards of Trustees. These community associations are responsible for adhering to their governing documents and complying with local, state, and federal laws. Community associations can substantially influence the quality of life of their residents, including property values.
The firm represents over 120 community associations providing guidance through the transition process from developer control to homeowner control; and general counsel for community association needs. Some of these needs include, but are not limited to: negotiating and/or litigation, if necessary, with developers regarding transition issues; advising Boards as to their fiduciary responsibilities; interpretation of governing documents; drafting of policy resolutions; enforcement of governing documents and association regulations; contract review and contract drafting for association services or purchases; and attendance at Board meetings.
In addition, the firm’s Collections Department works on behalf of community association clients seeking payment of delinquent maintenance fees and charges.
